Before accepting the Agreement, you must carefully read all the content of the Agreement and fully understand its terms, especially the restrictive clauses or exceptions. The restrictive clauses or exceptions are in bold or highlighted in other ways to capture your attention. If you have any doubts about the terms of the Agreement, please contact the relevant business department of BESTQI INTERNATIONAL LLC. You are not allowed to use the service before you have read and accepted all the terms of the Agreement, relevant agreements, and rules, etc. Once you select 'accept and submit the Agreement' (see the registration page for detailed wording) and complete the registration procedure, or use the service in any way, it will be considered that you have read and accepted the restriction of the Agreement and the above rules. In case of breach of the Agreement, BESTQI INTERNATIONAL LLC. has the right to restrict, suspend, or unilaterally terminate the service for you, and has the right to investigate your corresponding liabilities.
The Service Agreement (hereinafter referred to as 'the Agreement') is signed by you and BESTQI INTERNATIONAL LLC. It includes (but is not limited to) the Privacy Policy of BESTQI INTERNATIONAL LLC and other content. In case of changes, BESTQI INTERNATIONAL LLC will announce through the licensed software by sending a message without further notice. Upon announcement, the changed agreement and rules automatically become part of the Agreement, without further notice to you for your consent. In case of objection to such relevant changes, stop using the service of BESTQI INTERNATIONAL LLC; if you continue to use it, it will be considered that you have no objections to the changed rules and agree to comply with them.
I. Definitions of Terms
1.1 The licensed software refers to software systems developed by BESTQI INTERNATIONAL LLC., downloaded, installed, and applied on specified system mobile terminals.
1.2 The services refer to the services provided to you by BESTQI INTERNATIONAL LLC. and its suppliers. You can use such services on the mobile terminal with licensed software.
II. Service
2.1 BESTQI INTERNATIONAL LLC offers you smart life equipment management services, based on which you can access smart terminals in BESTQI INTERNATIONAL LLC. and the smart platform of its suppliers through BESTQI INTERNATIONAL LLC. Control, and perform interconnection between smart devices. The service contents include smart device management, scene interconnection, and analysis reports, etc. Such functions may be optimized or modified according to changes in user demands or the judgment of the service provider, and service provision may be suspended due to regular and irregular maintenance.
III. Scope of Service
3.1 BESTQI INTERNATIONAL LLC. grants you the right to use the product based on this software.
3.2 You are prohibited from licensing, selling, leasing, transferring, issuing the product in any form, or using the product for other commercial purposes.
3.3 Due to limitations in the software adaptation platform and terminals, you can only use the licensed software on authorized system platforms and terminals; if you install the licensed software on another terminal device, it may damage your hardware or software function.
3.4 You acknowledge that the licensed software can only be used for non-commercial purposes, and the installation, application, and execution of the licensed software are prohibited. If such commercial operation is necessary, written authorization and permission from BESTQI INTERNATIONAL LLC must be obtained.
3.5 BESTQI INTERNATIONAL LLC. and its suppliers may change, update, or transfer the licensed software or relevant functions from time to time, and may add new functions or services to the licensed software system. If there are no separate agreements accompanying the mentioned new functions or services, you have the right to the corresponding functions and services, which are also subject to the Agreement.
3.6 You will be responsible for the accuracy, reliability, integrity, and legality of the input data and the legality of how you obtain the data, and you should back up the data and information from time to time. You assume all risks for damages and losses of such information.
3.7 You must properly maintain your account number and password. In case of any security breach in your account (including, but not limited to, disclosure of the user password), you must notify BESTQI INTERNATIONAL LLC. in a timely manner, and BESTQI INTERNATIONAL LLC. will assist you in taking relevant measures. Otherwise, all behaviors related to your account will be assumed by you, and you will assume all responsibilities.
IV. A Third Party
4.1 You acknowledge that certain services of BESTQI INTERNATIONAL LLC. and its suppliers are based on software or services provided by a third party. Such service is configured to facilitate your application and the necessary legal authorization from the third party has been obtained.
4.2 The product includes certain information and services from third parties. BESTQI INTERNATIONAL LLC. and its suppliers do not control or are responsible for the information and services from third parties.
4.3 You acknowledge that BESTQI INTERNATIONAL LLC. and its suppliers cannot guarantee that the licensed software will always use or contain such services, or that other software provided by the same third party will be used in the future. Likewise, you may use similar services provided by another third party. When applying, the corresponding software or services mentioned are subject to this Agreement.
V. Service Application Standard
5.1 You must use the licensed software normally. The following forms constitute a violation of the application standard:
1) Issuing or sharing computer viruses, worms, malicious codes, or software that deliberately damages or alters the computer system or data;
2) Collecting information or data from other users without authorization, such as email addresses and similar;
3) Maliciously using the product automatically, causing overload to the server, or interfering with or damaging the web server and network links in other ways.
4) Attempting to access server data or communication data of the product without authorization;
5) Interfering with or damaging the production application of other users.
5.2 You understand and agree that:
1) BESTQI INTERNATIONAL LLC. will determine whether you are involved in the violation of the above standards, and will suspend or terminate your application license according to the determination results or take other restrictions according to the agreements.
2) BESTQI INTERNATIONAL LLC. will directly delete information that violates laws, or infringes the legal rights of others, or violates the Agreement issued by you when using the licensed software.
3) If a third party suffers damages due to your violation of the application standards, you will independently assume legal responsibility in your name, and protect and indemnify BESTQI INTERNATIONAL LLC. from additional losses or expenses arising from it. Otherwise, BESTQI INTERNATIONAL LLC. has the right to claim compensation.
4) If BESTQI INTERNATIONAL LLC. and its suppliers suffer any loss due to your violation of relevant laws or the Agreement, you shall compensate BESTQI INTERNATIONAL LLC. and its suppliers for the losses and (or) expenses arising from it.
VI. Information Content Standard
6.1 You promise not to engage in any acts that violate laws or inappropriate behaviors when using the service, such acts and behaviors include (but are not limited to):
6.1.1 Uploading, transferring, or sharing information that contains one of the following contents:
1) Opposing the basic principles established in the Constitution;
2) Endangering state security, disclosing state secrets, subverting state power, and sabotaging state unity;
3) Damaging the honor and interests of the state;
4) Inciting national hatred and discrimination and sabotaging national unity;
5) Destroying the state’s religious policy and advocating heresy and feudal superstition;
6) Spreading rumors, disturbing social order, and destroying social stability;
7) Spreading obscenity, pornography, gambling, violence, murder, and terror or inciting a crime;
8) Insulting or defaming others and infringing on the legal rights and interests of others;
9) Containing deceptive, fraudulent, harmful, threatening content, infringing on the privacy of others, harassment, infringement, defamation, rudeness, indecency, or morally repulsive content;
10) Containing other content restricted or prohibited by laws, regulations, rules, provisions, and other applicable legal standards.
VII. Privacy and Data Policy
7.1 It is crucial for BESTQI INTERNATIONAL LLC to protect your personal information. BESTQI INTERNATIONAL LLC prepares the Privacy Policy of BESTQI INTERNATIONAL LLC, which discloses content related to the ownership and protection of intellectual property, the collection, use, sharing, storage, and protection, etc. of your information. You are advised to read the Privacy Policy of BESTQI INTERNATIONAL LLC carefully.
VIII. Exception Clauses
8.1 Unless otherwise specified in laws and regulations, BESTQI INTERNATIONAL LLC will do its best to ensure the security, validity, accuracy, and reliability of the licensed software and technologies and the information involved, but BESTQI INTERNATIONAL LLC cannot guarantee the same due to the limitations of currently available technologies.
8.2 You understand that BESTQI INTERNATIONAL LLC will not assume responsibility for direct or indirect losses caused by force majeure and the non-compliance of a third party.
8.3 You will be responsible for personal injury or incidental or indirect damages caused by or related to one of the following accidents: 1) A third party uses the licensed software or alters its data without permission; 2) Expenses and losses incurred from the use of the licensed software; 3) Your misunderstanding of the licensed software; 4) Other losses related to the licensed software caused by reasons not attributable to BESTQI INTERNATIONAL LLC.
8.4 Any other software derived from the licensed software that has not been developed and published by BESTQI INTERNATIONAL LLC or whose development and publication are not authorized by BESTQI INTERNATIONAL LLC is illegal software. Downloading, installing, and using such software may cause unpredictable risks. BESTQI INTERNATIONAL LLC will be exempt from legal responsibilities and disputes arising in this regard, and BESTQI INTERNATIONAL LLC will have the right to suspend or terminate the application license and/or all other services.
8.5 You have been informed that the use of BESTQI INTERNATIONAL LLC and its provider's smart platform involves Internet services, which may be affected by unstable factors across all links. Although BESTQI INTERNATIONAL LLC has taken protective measures, the service may be suspended, terminated, delayed, face application restrictions, or application failures due to inherent defects of the Internet and electronic communication, as well as factors beyond the reasonable control of any party to the Agreement (including, but not limited to, fire, flood, terrorist attack, plague, natural disasters, riots, terminal viruses, hacker attacks, network failures, and terminal failures). You hereby agree to assume the above risks and accept that BESTQI INTERNATIONAL LLC is exempt from any liability when the normal operation of the services is affected by the occurrence of the above risks.
IX. Termination of the Agreement and Breach of the Agreement
9.1 You must understand that you must use the licensed software in accordance with the scope of authorization, respect the intellectual property of the software and the contents contained in the software, and fulfill the obligations in accordance with the Agreement when using the services of BESTQI INTERNATIONAL LLC. BESTQI INTERNATIONAL LLC. will terminate the application license if you incur a material breach of the Agreement.
9.2 Your application of the software depends on the support services provided by related companies of BESTQI INTERNATIONAL LLC. Non-compliance with terms, agreements, rules, announcements, and other relevant regulations of BESTQI INTERNATIONAL LLC. and its related companies may cause failures in the normal use of the licensed software, in which case, BESTQI INTERNATIONAL LLC. will have the right to terminate the application license or take measures to restrict your application license or other rights and interests controlled by BESTQI INTERNATIONAL LLC. as agreed in the Agreement, including the suspension or termination of your application license.
9.3 In the event of a breach of the Agreement or other agreements signed with BESTQI INTERNATIONAL LLC., BESTQI INTERNATIONAL LLC. and its suppliers will have the right to notify related companies, requiring them to take restrictive measures on their rights and interests, including requiring related companies to suspend or terminate the provision of part or all of the services to you, and legally announce your breach of the agreement on websites managed or controlled by them.
9.4 The licensed software is downloaded from the download platform, and you must comply with the stipulations of the download platform, the system platform, and the terminal manufacturer regarding the application methods and restrictions of the licensed software. If the mentioned third party confirms that you are breaching the agreement and treatment by BESTQI INTERNATIONAL LLC. and its provider is required, BESTQI INTERNATIONAL LLC. may terminate your application license at the request of the third party.
9.5 When the application license terminates, you must stop using the licensed software and destroy all copies.
9.6 You must assume all compensation responsibilities if BESTQI INTERNATIONAL LLC. and other users suffer losses caused by your breach of the terms of the Agreement.
X. Applicable Laws and Severability
10.1 The effectiveness, explanation, change, enforcement, and resolution of disputes of the Agreement are subject to the laws of Please enter the appropriate jurisdiction. If there are no relevant laws and regulations available, reference will be made to general international business practices and (or) industry practices.
10.3 When any term of the Agreement is deemed invalid by such court, it will not affect the effectiveness of other terms or any part thereof, and you and BESTQI INTERNATIONAL LLC. must comply with the valid terms in good faith.
